Build a Hotel on Rustic Land in Spain? What a DIC Gives You

18 October 2026 · Hansson & Hertzell

Can you build a hotel on rustic land in Spain? What a DIC gives you in Valencia, what an extraordinary use costs in Andalucia, and five checks before you buy.

Sometimes, yes, but never on the strength of the land alone. In Spain land is urban (suelo urbano), land to be urbanised (suelo urbanizable) or rustic (suelo rustico, called suelo no urbanizable in the Valencian Community). On rustic land the general rule is that you cannot build what belongs in a town. A hotel is possible only through a specific exception, granted for a specific project.

Which exception depends on the region:

  • Valencian Community (Costa Blanca, Valencia): the DIC, the Declaracion de Interes Comunitario.
  • Andalucia (Costa del Sol): an extraordinary use (actuacion extraordinaria) under the LISTA land law, Ley 7/2021.

Many of the most beautiful hotel and resort sites on the Spanish coast sit on rustic land. That is exactly why the word "DIC" appears in so many sale dossiers, and why it deserves a careful read before it is priced.

What a DIC is

The DIC is a Valencian planning instrument that allows, exceptionally and restrictively, uses that normally belong on urban land to be placed on suelo no urbanizable. It was created by the 1992 Valencian law on rural land and is governed today by the consolidated planning law, the TRLOTUP (Decreto Legislativo 1/2021).

In practice it is the step that turns a rural estate into a hotel project. Recent cases on the Costa Blanca show the range:

  • in Elche, the historic Villa Maria-Ana de los Ros is moving through the DIC process to become a rural hotel;
  • in Finestrat, a developer started a DIC to classify an existing complex as an apartment hotel;
  • in Benidorm, a new campsite needed a DIC because part of the land is non-developable under the general plan.

A DIC is granted for a defined use, on defined land, with conditions and for a set period. If the administration does not resolve in time, the application is treated as refused. Silence is not consent.

What a DIC is not

  • It is not a building licence. After the DIC you still need a licencia de obras from the town hall, with a full technical project.
  • It is not open-ended. The use, the size, the conditions and the duration are those written in the resolution, and nothing more.
  • It is not guaranteed to survive a sale on its own terms. Who holds it and what happens on a transfer must be checked in the resolution.
  • It is not uncontested. DICs for large projects are regularly challenged. In Alicante a proposed modification of an existing resort's DIC was argued to be "a substantial impact on the territory" rather than a simple expansion.

Five things to read in the resolution before you value the land

  1. Number and date. A DIC that cannot be quoted by number and date has not been shown.
  2. Scope. The exact use (hotel, rural tourism, wellness), the number of units or beds, the built area.
  3. Conditions. Fees (canon), works to be executed, environmental and access conditions.
  4. Duration and deadlines. How long the authorisation lasts and by when it must be built.
  5. Who holds it. And what the resolution says about a change of owner.

In our own due diligence the DIC is often the single document the asking price rests on. When it is claimed but not provided, we value the land without it, and show the buyer the difference between the two numbers.

A small rural hotel can be a different case

Some rural-tourism accommodation does not need a DIC. Under the TRLOTUP, a rural tourism establishment that restores traditional architecture in existing buildings with a licence, up to 500 m2 of built area, is exempt. The regional tourism rules also cap a "rural" accommodation at 50 places, in a building of traditional architectural value. A resort is not that case.

Andalucia: extraordinary uses under the LISTA

On the Costa del Sol the route runs through Andalucia's LISTA (Ley 7/2021). Uses of public or social interest, including tourist uses, can be authorised on rustic land as actuaciones extraordinarias. They carry a compensation payment of up to 10% of the works budget, excluding machinery and equipment, and each municipality may set a lower rate by ordinance. Andalucia also allows a family home on rustic land under strict conditions, typically on plots of at least 2.5 hectares. A hotel is a different, larger case.

The rule of thumb

On rustic land, the instrument is the asset. A plot with a valid, quotable DIC or an authorised extraordinary use is a hotel project. Without one, it is rural land with a hope attached, and should be priced as rural land.

How we check it

Every plot in our development collection is checked against the official record before a single image is drawn: the cadastre, the planning rules and, where a DIC or an extraordinary use is claimed, the instrument itself. What is confirmed, what is researched and what is only stated by the seller are kept apart. You see which is which. See how we did it for a hotel site in Marbella: La Concha Gardens. The full method is in our feasibility checklist for buying land in Spain.

Own land with possibility? We study it the same way.

This article is general information, not legal advice. Each DIC and each municipal ordinance must be read in full for a specific plot.

Frequently Asked Questions

Can you build a hotel on rustic land in Spain?
Only through a specific exception for a specific project. In the Valencian Community that is a DIC (Declaracion de Interes Comunitario); in Andalucia it is an extraordinary use (actuacion extraordinaria) under the LISTA law. The municipal plan must also allow the use.
What does DIC mean in Spanish planning?
Declaracion de Interes Comunitario: a Valencian planning instrument that allows, exceptionally, uses that normally belong on urban land, such as a hotel, to be placed on suelo no urbanizable (rustic land), for a defined use, with conditions and for a set period.
Is a DIC the same as a building licence?
No. A DIC authorises the use on rustic land. You still need a building licence (licencia de obras) from the town hall, based on a full technical project, before construction can start.
Does a rural hotel always need a DIC?
Not always. Under the TRLOTUP, rural tourism that restores traditional architecture in existing licensed buildings of up to 500 m2 is exempt, and a rural accommodation is limited to 50 places. Larger hotels and resorts need the DIC.
How much does an extraordinary use cost in Andalucia?
The LISTA sets a compensation payment of up to 10% of the works budget, excluding machinery and equipment. Each municipality can set a lower rate in its own ordinance.
What should I check before buying land with a DIC?
The resolution's number and date, its exact scope (use, units, built area), its conditions and fees, its duration and deadlines, and who holds it and what happens on a sale. If the DIC cannot be shown, value the land without it.
